Will is an important legal document to ensure effective estate planning and wealth distribution.

A WILL an official written succession document which notifies the wishes of the Testator (the person who writes the will) for distribution of his/ her accumulated assets and wealth, to the members of his/ her family, charitable organizations, relatives, friends and so on, after his death. In absence of an official will, the wealth is distributed amongst official inheritors according to applicable succession laws. Only the latest registered will, signed in presence of two witnesses (with the exception of priviledged wills by soldiers at war front), is considered final in courts of law.

Separate will is required for Joint holdings, depending on the holding ratio. This is because joint holders or nominees are only trustees,and not legal heirs/ owners of the wealth.

Will creation helps in avoiding intervention of court post death of the will creator, delays, costs and issues involved in the process.

A legally valid Will must:

  • Be made by a person of sound mind.
  • Have the Testator aged 18 or older.
  • Be signed by the Testator.
  • Be witnessed by at least two people.

Failure to meet these criteria can make the Will invalid, leading to disputes over your estate.
